Unpaid for 4 months

Hello,

I am an Apprentice and my employer has not payed me in 4 months. They say they are having a dispute with their funder but surely this should not affect my wage or my contract. I am owed over £1,000 for the four months. I am writing a letter of grievance but I am not sure what the best approach to doing this is. Can someone help?

  • Is your employer also the training provider? This is often the case in large employers with an internal, accredited apprenticeship programme or if you are employed in a college.
  • The owner of my employer also owns the training provider. However, they are registered as two different companies. The owner is the Managing Director of both companies.
  • OK, makes a little sense now although still not correct. Your contract of employment should be with the employer, and should not be subject to funding (you are employed by them the same as any other employee for at least the duration of your apprenticeship). The funding may be either;a direct Skills Funding Agency Funding contract for the provision of training
    an Apprenticeship Grant (£1500) although not likely as this is for organisations that have not had an apprentice before.
  • The way it has been explained to me from the managing director is that the training provider registers its employees with a college, who receive the governments money. The money the college receives is then given to the training provider. The training provider then gives the money to my employer who then pays my wage. Unfortunately due to an apparent dispute with the college, the training provider and therefore my employer is not receiving the money and therefore cant pay its apprentices.
  • You need to contact National Apprentice Service as this is a dispute about your contract with your employer. How your employer gets it's money is not really your concern, your contract is with them and someone with employment law knowledge on here should be able to help with that, my knowledge is around apprenticeships, funding & FE Colleges.
