No P45

Hi all,

My daughter worked in a local hotel but left due to college comitments(sp), shes at 6th form college. The said they would send out her p45, which they never did.. and we just forgot about it...

However she now as just got herself a job in a DIY store and they are asking for her p45, so daughter phoned the hotel, and they said phone back in a day or two when the owner was in... so she did only to be told the systems where down. Daughter then met up with another friend who also worked there and asked her if she ever got hers....she said NO, and that she phoned the Inland Revuene people up they siad they had NO record of her working there...

Any ideas what i can do and will it affect her new job

  • Is she a student? If she is then she won't get a P45 anyway. Has she filled in a P38 (Student Declaration) then she won't have to pay any tax.

  • I would suggest that your Daughter explains to her new employers that she is having trouble obtaining her P45 and that she would like to fill in a P46. Her new company can then put her on the appropriate emergency tax code whilst they wait for your daughters correct coding from Inland Revenue.

    If your daughter works during term time then she would/will be subject to tax (only students who work during the holidays only can complete a P38 to exclude them from tax)

    And then only if they're not expecting to earn more than the personal allowance - it's a myth that students don't have to pay tax! The only reason students are exempt from paying tax is if they don't earn more than the personal allowance!

    Back on topic, as we're in a new tax year, and her P45 was presumably issued in the last tax year, I don't think it will make any difference that she doesn't have one. P46 is the way to go.

    ALL workers should receive a P45 once they leave an employer!

    The other posters are correct in their posts about students and tax implications.

    Although if you don't get it automatically, when the tax office realise you've started a new job they may ask you where else you've worked, and write to your previous employer to find out why a P45 wasn't issued. I used to do PAYE for an out of school club, where we employed lots of students. Some worked term time only while they were at Uni, and some worked holidays only while they were at home. Which worked well, until they started new jobs without telling me they'd left the old one! :rotfl:
