Who on CSA2 has to pay their CTC to their ex (PWC)

Does anybody have their NEW partners Child Tax Credits taken into account and paid to the PWC?

    If the NRP earns more than their partner, the money is deemed to be theirs I believe.

  • Are you asking about a direct payment of CTC to PWC or if it's taken into account?

    My sister's WTC and CTC is listed as income for the purposes of her husband's CSA payments even though she isn't actually receiving it for three years because of a tax credit overpayment.

    It is deemed to be the income of the NRP. If the partner earns more than the NRP then the income is deemed to be hers and is ignored. Sorry if I didn't make it clear.
  • You've still not made it clear Kelloggs. CTC is ALWAYS deemed to be the NRP's income, whoever it's paid to. WTC is the NRP's income if NRP earns more than the NRPP and NRPP's income if NRPP earns more. THe CSA take 50% of WTC into account if earnings are exactly the same.

    Mine isn't taken into account......as far as i'm aware.

    But , 2 of the children we receive CTC (we don't get WTC) for are mine & not his.... does that make a difference?

    He earns roughly £100 a week more than the amount of CTC we receive.

  • I'm trying to find the Statutory Instrument which sets out the calculation. In the meantime, from the CSA website:-

    Working Tax Credit will be treated as income where the non-resident parent is the main earner. Where the non-resident parent and their partner have equal earnings 50 per cent of the tax credit will be taken into account as income of the non-resident parent. Child Tax Credit will be taken into account as income of the non-resident parent whether it is paid to the non-resident parent or their partner.

    I've read all that Mr GG & i'm still confused.......more than ever now:rotfl:


    When i put hubby's wages into the CSA's online calculator, the amount that comes out is exactly the amount he pays........so, in my opinion, that means our CTC isn't taken into account. Like i said before, would this be because most of our assessment is for my children & not ours...if you know what i mean.

    Does this mean he can expect a large bill in the future when they do a review?:confused:

    The PWC (in our case) has just decided she wanted a review done to see if she could get more money... and we are going to be sending his wage slips. Up to now, no CTC has been taken into account and I will be annoyed if it will be taken into account as we will be getting help with childcare costs.

    We have received a small amount of CTC since our first child was born a couple of years ago, yet this has not been taken into account but the CSA have never asked for anything except wage slips, which were duly sent off. How can we be liable for back payments or told we owe more because we were earning CTC, when we weren't made aware of it by CSA?

    We are under review at the moment but have just been reassessed as we had another baby.... the PWC was annoyed her money went down and wanted to see if she could get more out of us... sad bitter woman she is!!! :D

    I don't think the CSA are pushing us as we have always paid, always been co-operative and never made their job harder by avoiding them or ignoring letters. She has just given them more work to do after they had already done their reassessment.
