Council Overpaid Wages

Hi chaps, hoping someone can help! The Council trying to be sneaky as always..

My sister was on an Apprenticeship and has just completed an NVQ in Business Administration with our Local Council. She was paid £95 per week for 37 hours per week. I believe the hourly rate was something miserable like £2.58 per hour. She worked Mon-Thu 8.30am-5pm and Fri 8.30am-4.30pm with 1 hour unpaid lunch. She worked from November 2011 and her last working day was Thursday 27th September 2012.

They have since sent her an invoice claiming she owes £41.80, how they figured that one out is beyond me. She rang the Payroll woman and she told her that they work it out by taking her monthly pay which was £418.01 and divided it by the amount of days in the month, in this case 30. They then multiplied this by 27 days and invoiced her the difference.

My question is, where is the logic in this? She didn't work 7 days a week, so how could they use the remaining Friday, Saturday and Sunday of September as the difference? She agreed she owes the Friday, which by my calculation would be approx £19 for that day's work.

If you work it out using the 'formula' the Payroll woman used, if she was being paid for 7 days a week, then infact she has been underpaid, well below NMW. Even though they do not work Sat/Sun, infact the offices are closed!

The Payroll woman she spoke to was quite snotty, she insists it is correct. Can anyone back up her logic or confirm that my own maths is about right and she only owes £19?

    I make £95 x 52 weeks = 4940

    4940 / 12 = £411.66

    I would ask for a week by week account of what she worked and what they paid her, asking them where the difference is (not how they have worked it out)

    It's easy for her to work out herself, take the amount of full weeks worked and x by £95. Was she paid this is total for the time she was there?

    Some Councils, the one I work for does anyway, technically pay you for weekends, so when working out how many days to pay you, and for working out annual leave entitlement, weekends are included
    Debt free and staying that way! :beer:

    Was she actually paid weekly or monthly? If weekly, and they paid her in full for the last week, then she'll only owe them the 7 hours she would have worked on the friday. (so £95/37 x 7 = £17.97)

    If she's paid monthly, then their calculation is correct.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No idea were the monthly pay figure came from. But since has been there she has been paid £418.01 per month, every month.

    I still don't understand how the calculation works out? She wasn't there for the last working day of the month which 7 hours. So she owes 1 days' pay, which is approx £18-21 depending on her exact hourly/weekly rate.

    Because it's not done on the days she works, it's done on the % of the month that she was there, so if she worked until the 27th, she was there 27 out of 30 days of that particular month, so 90% of the month.

    If her monthly pay was £418, then she'll have 10% deducted, which would be £41.80.
