Agency holiday rights - temp worker

  • If you actually ended working for them before the end of the year, they would have to pay you for any holiday accrued but not taken. That is the law.

    Have you considered working for a different agency?

    If money is very tight you could even take paid holiday from the current agency and then work through another one at the time of your holiday.

    I would but I actually really enjoy my job (just not the agency part.) I thought that after 12 weeks in the same job you had all the rights any permanent member of staff had but that just doesn't seem the case here.
  • does it matter if you go through an employment agency with your own limited company?
    I am told if I have a day off I lose a days pay?

    You don't have all of the rights of directly-employed staff. Some rights apply from Day One but the right to equal pay and holiday entitlement is after 12 weeks.

    In that case you are not employed by the agency but by your limited company. It would be for your company to pay you for holiday. You need to look at what you are paid by your company and what the agency pays the company.

    As far as I can see, yes it would.

    Please get the precise wording of how they work out what they pay when you take your holiday. Without the precise wording it is difficult to say for sure.
