• Well, the plot thickens in relation to this.

Having pressured the only other person living at this address at the time I was, (a sibling) they finally admitted that they opened this account with Shop Direct in my name and took delivery of goods whilst I was at work.

Needless to say i'm extremely ... well ... i wont express my emotions on here, but thankful that they've finally admitted to it.

The problem I now face is that I'm stuck with a moral dilemma as you can understand.

I've already pointed out the countless mistakes with this account to Lowell (No DN, Unlawful termination, No valid CCA etc... this list is endless). But if money is legitimately owed i'm not going to shy away from resolving it;

Having finally been sent a statement, the o/s amount is made up of 55% charges. So, my sibling has agreed to pay me back, and I have sent a letter to Lowell's explaining the situation, referring to their failures on all counts and making a F&F offer of amount less charges + removal of Default from file. Which I think is more than fair?

Hopefully they'll accept and can finally put this to bed. I think i'll buy a punchbag with the remaining amount....

F&F settlement accepted - With removal of default and all adverse data

Finally can put this to bed to move on :D
Following a review of your case and based upon the information provided below, I am pleased to confirm that we will accept £xxxx as full and final settlement of your debt. Therefore, I can confirm the residual balance will be written off as a gesture of goodwill and without the admission of liability. In addition, once payment is received you will not receive further contact from us or any of our affiliated companies.

With respect to the default, on this occasion I will be removing any adverse data which is registered on your credit file upon completion of the funds made to us purely as a goodwill gesture.

I will place the account on hold for 28 days and allow you the opportunity to contact me and pay either via debit/credit card. After this time, the account will revert back to our Collections Department and the discount may be invalidated.

I trust this satisfactorily resolves the matter in a manner which is amicable to both parties.

Congratulations and well done. A nice post to read.

I hope the sibling is paying the settlement for you...
• :D Thankyou, feels good to be finally rid of it.

Obviously annoyed that through my brothers actions and dishonesty I've been taken for a fool, but he's given me twice as much as the settlement figure in way of an apology, doesnt excuse two years of default on my file, but better than nothing.
