Statute Barred?

Not sure if this is the correct section?

I signed up and the consumer forum and have had some great advice but which I mostly ignored the same as my debts.

I think they are statute barred but not sure.

For some reason nobody has replied to my latest posts.

Anyone a member? I have the same username could you look for me please.

I cannot post links but same username, And after the main sites URL is

That is the last page and the credit file was from July I think.

Please help.

    They will want to know when was the last time you axctually acknowledged your debts in writing or by making a payment.

    Cannot access my equifax report, I did the online £2 one and it wont let me access it now. Silly me didnt save it.

    Experian i did save though.
    Creditor #1 in my list, CC company months 61 - 72 = 8?? ??? ??8 843 So i presume 2 months from the report
    would put them all at 8's. And that report was 2 months ago. So SB?

    I assume the others listed with less months would be down to those not being the original
    creditor and those are the dates they took them over?



    I have trawled the draws and cupboards and found a few letters than missed the shredder. Seems the MBNAicon debt may not have been paid in august 2006.
    Settlement offer of installments for 125 months.. £77 a month. From what i can see the credit limit was £6000?
    FOUND IT:
    Letter dated September was the one that caused all the problems and pushed me over the edge.

    My goal is not to antagonise you, but to come up with a straightforward plan so that you can repay your debt in a way that is manageable for you.

    Sorry, Its got me wound up again. I was ill and on £60 a week sick pay.

    Thanks for putting up with me. I just wish i could have logged in and there was a date with the last
    payment and a light at the end of the tunnel.

    OK i cant sleep, Found a couple of letters from Monument, bought out by Barclaysicon or owned by Barclays?

    15 August. My bank contacted them regarding cancelled DD instruction. Cancelled with immediate effect.
    4th Sept Not received payment. So maybe my dates are mixed?

    I think the issue maybe me asking for help and worried they will find me online and people i know would
    find out. I changed the dates and actually forgot the real dates.

    I must look like a right fraud and making these stories up. But believe me 6 yearsicon of being scared to answer
    the door or the phone is not funny.

    You need to resort to old fashioned paper.

    For your credit history:
    http://www.ico.gov.uk/for_the_public/topic_specific_guides/credit.aspx

    For your data (from the original creditors).
    A subject access request:
    http://www.ico.gov.uk/for_the_public/personal_information/how_manage/access_info.aspx
    A good template here - adapt to suit.

    You need to include the statutory payment of £10 for this. A postal order is preferred.

    All letters should be printed, your name signed over a tamper proof strip and then scanned back to your PC. Then sent "signed for".
  • Is that just for the credit report which i got from Experian and Equifax a little while back?

    Could you see the picture in the above post, shows my credit file from July I think. 888 on months 68 etc..

    So it appears to me to be barred?

    If you have read my posts on the other site, I opted for the sitting on my hands and hoping nothing happened.

    Now I am fretting just in case.

    You're obviously worried & distressed, but I have to admit that I'm struggling to understand your situation. From what I understand:

    You had £6K credit with MBNA, which hasn't been paid since August 2006
    You received a letter this September from a debt collector about this
    You've not responded to any letters about this debt

    Please correct me if I'm misunderstanding any of this

    If you have not paid anything since August 2006 then it is statute barred as it's over 6 years since you've acknowledged the debt. There are template letters around, but I don't have the links to hand right no.
    Total Debt 13th Sept 2006 (exc student loan): £6240.06 :eek:

  • I acknowledged the debt in September 2006.

    Cannot remember exactly when I stopped paying but a recent letter I found seemed to show I cancelled the direct debits in august and not September. But not sure what payments I made after that.

    Someone said they have a habit of bumping the debt by taking it to court just before the debt is statute barred.

    Seems I cannot check this and worried because my post is going missing lately.

    Not sure if they are ignoring me because they think its statute barred or the fact after taking their advice to contact the debt collectors to prove the debts.

    I got worried that this would start them off harassing me more and I chose to sit on my hands and do nothing.
    Against their good advice.

    I know it was not the best thing to do and I just want it all over.

    I thought the credit report would give me a clearer answer but not sure if those 8's on the pictures mean its statute barred yet. One only shows as being 8's for 4 years. But I think that is when it changed hands to the debt collection company.

    PS. It was a lot more than just the MBNA debt.
