Higher Lending Charge (HLC) paid twice in one year

Halifax charge a higher lending charge for a mortgage over 95%, I had taken a mortgage out and paid this and then when we came to move within a year we had to pay it again because we could only afford a 3% deposit, so in one year i paid £1116 twice totaling £2232 for a higher lending charge.
So i paid all this just to take myself to court if i screwed up my mortgage, can i claim any of this back as i have not faultered once with my mortgage

I don't see why you should be able to pay this back it is a legitimate charge, and nobody forced you to move house did they?I am a Mortgage Adviser

It was an enquiry to see if Halifax Bank/Mortgage could do this, i do feel its unfair to charge someone for just moving thier mortgage to another house 8 months later. I do agree with the 1st payment, but when we moved our mortgage actually went down a little. I stayed with the Halifax and remained a loyal customer, but i had to pay the charge again.
As to reply whether anyone forced me to move, the answer to that would be No-in relation to banks or work but Yes as family life dictated this and we couldn't live in a 1 bedroom bungalow and needed to move to a 2/3 bedroom house.0 -
