Private car parking fine

Hi,

On the 04/09 my mother received a car parking ticket from a BPA registered firm. She was not the driver at the time of the incident therefore I looked to resolve this issue on her behalf by stating .to the firm that she is not liable for this reason (using the guide on this website).

They ignored my initial letter and requested payment again however the new guide on this site now states:

"as of October 2012, parking operators are allowed to hold the vehicle's keeper liable for unpaid parking charges if they don't know who the driver isand the keeper refuses, or is unable to name the driver"

Does anyone know where I stand given that the time of the incident was before October 2012?

Any help very much appreciated.
