Holiday Pay?

My wife just came home and said she had spoken to a friend who works full time in a local cafe, they have worked there for some 20+ and are paid weekly and pay tax. They dont however, get paid any holiday pay. Can this be possible and legal?

    Statutory minimum paid holiday entitlement for a f/t employee is 28 days per annum which includes bank holidays.

    Assuming "full time" means working 5 or more days a week, the employer is not acting lawfully if they do not pay your wife's friend for any holiday taken if they have requested it.

    They should start asking.

    It could be possible but it's not legal. Her friend is entitled to a minimum of 5.6 weeks paid leave which can include bank holidays which the employer must let them have but it is up to the employee to make sure they use them.

  • Thank you all, I was amazed when my wife told me and even today one of the staff is off having been in hospital and will have to have another week off, all without a penny sick pay. There must be 6 staff in all. They must be afraid they would lose their jobs if they say anything. I will look on the owner in a different light from now, thanks again.

    If the staff member is only part time she may not be eligible for sick pay, you need to earn an average of £107 to qualify. If on the other hand she is eligable then the company are breaking the law and all the staff need to get together and address the problems.
