Leaving one employer & starting with another -date overlap?

Hi,

I'm not sure if I'm in the right place, but I'm sure one of you good folk will move this thread if not! :)


DH is working his 3 months notice from his employer, his new employer want him to start ASAP.


Is it allowed that you could take any hols owing to you at the end of the notice period & therefore leave after say 2 and a half months. But then start for the new employer whilst technically still on hols from the first?
Therefore getting paid by both new & old employer?

  • I think this is quite normal. I don't believe there are any implications except that you obviously might get taxed more for the period of overlap because you'll be getting paid for both jobs. The new employer will be happy because a lot of people would take the leftover holiday as a chance for a break between jobs! :)

    Yes, providing the first employer agrees.

    They do not have to let him take accrued holiday during his notice period, they could opt to pay him for it after he leaves.

    If he is on holiday then technically he is still employed so he MIGHT be in breach of contract by working elsewhere. In reality I very much doubt they would mind.
