former employer not paying wage

Advice please as my son has just left employment and the employer has not paid him. The job was relatively new and when he gave notice the employer became very abusive but my son stayed and worked his shift. He is owed 8 days and was told that he wouldn't be paid or get a reference. He's got a better job but surely withholding pay is illegal. When he rang his former employer he was told because he didn't give them a tax code he would have to wait another month??????

    Withholding monies he has legally earned is illegal. You mentioned that due to them not having his Tax code he would have to wait another month.
    If that is the case, then I would give them until the end of the 1st week of November, the send them a notice before action (1st Class Recorded Delivery ONLY, not via untrackable sources such as email, fax or standard post) followed by Small Claims Court action might make them understand he is not going to back-down.

  • Thanks for that. Really think they are fobbing him off. How is next month going to be any different. When he gave notice the guy was so abusive and personal - my son is 21 - and now he does this.
