Stupid Partner!!

Have never been in debt in my life, but my partner has an outstanding debt with Natwest, which has thrown a huge spanner in the works of our mortgage application! The debt was transferred to Bryan Carter and Co Solicitors around 3 years ago when my partner lost his job and defaulted, but he has dutifully paid it ever since. I don't understand how all this works, as I stated, have never personally been in debt. If we go to Natwest and ask for the 'middle-man' (Bryan Carter) to be cut out of the equation, and for my partner to pay Natwest back directly, would this be possible? Does it work that way? I've read absolute horror stories about this Bryan Carter, and don't want them involved in any aspect of my life.

  • Just to clarify.. I'm not asking for mortgage advice, I'm asking if we head on into Natwest tomorrow, would my partner be able to make payments directly to them, and cut out the 3rd person?

    Can't see it, Bryan Carter place must own the debt now and the payment should be paid to them I would think but I could be wrong.

    It depends on whether Bryan Carter are acting on behalf of Natwest or if NW have simply "sold on" the original debt.

    You won't lose anything by asking but if the debt has been sold on then technically, your partner won't owe Natwest anything, he will simply owe the money to BC.

    Sadly, the debt will be on his file for 6 years from the date of the original default. If the debt is owned by BC, could he offer a "Full and Final" amount, to clear it at least? He would need to ensure that the debt was marked on his credit file as cleared, there are certain terms that the debt collectors will have to agree to, in writing, for that to happen.

    Mortgage lenders are notoriously fussy now about lending to customers with a dodgy credit rating. If you do manage to get a mortgage, you can probably expect to pay through the nose for it, at least for the first few years. Good luck though, I hope you get a result!

  • This was my original thought on it, but the statements still come from Natwest, if they'd washed their hands of the debt, the statements would come from Bryan Carter in some way?? He's got no paper-work, no nothing from this company, has lost the absolute lot.. and I'm 9 weeks away from giving birth, so as you can imagine, this stress is the last thing I need.. grrr.. as title says - 'stupid partner' lol
  • From what I can gather, the debt hasn't been sold, they are acting on behalf of Natwest. What I don't understand is that nothing shows up on his credit score, we breezed through that?? The problem only arose when the mortgage company asked for bank statements, picked up that he pays B Carter every fortnight, and now want answers as to what the deal is.
  • If it helps, I defaulted on an Argos Card plan and it was sent to BC, they offered a 70% F&F settlement so even if the debt is still with them it could be worth trying to bring it down and get it paid off.

  • It's what amounts to a large debt in my eyes (just over £6,000), so my next plan of action regardless is to get it paid off, he's only paying £35 a month at the moment, which is ridiculous, we can afford a lot more than that, and I'm assuming that's interest-only!! How ANYBODY manages to get a mortgage these days is beyond me! Between us we have a house-hold income of £40,000.. and we're only after and £85,000 mortgage lol! Never seen so much nit-picking in all my life! Thankyou for your input Conisme x
