Been Refused Payment For Hours I Worked...

Hi,

About four weeks ago, I started working at a disabled peoples hotel. I was asked to go in for an interview at 9.30am, which I did. When I got there, I was just asked if I could start there and then as a trial to see how I got on. I didn't even get a minutes interview.

When I had finished this three hour shift (Where I had to clean up peoples feces off the floor), I was asked if I wanted to start properly the next day, which I did, and I also worked the day after. After realising that I wasn't really making any money after the petrol costs to travel there everyday, I phoned the hotel and spoke to the receptionist and told her I won't be returning and I explained why and asked her to let the Manager know.

Two weeks later I still hadn't received the payment for the hours I worked so I sent the Manager an email asking when I should expect to receive this payment, and I got no reply. After a week had past, I again emailed the manager, and again, I got no reply. I have just phoned him this morning and he's told me I won't be paid for the hours I worked (I worked 10 hours in total) as I didn't work a weeks notice.

After I got off the phone to him, I phoned Acas who have told me that I didn't have to work a weeks notice as I had only been working there three days (You have to be working with the company a month before you have to work a weeks notice). They have told me to send the Manager a letter explaining this and request the payment for the hours I have worked again.

I just know this won't work as the Manager is a pr*ck and he's just trying to be really awkward.

Has anyone get any ideas as to how I can get the money I am owed. I am willing to take them to court, but after court costs, I'm still going to be losing out.

    Write a letter and send recorded delivery and ask for payment for all hours including the trial to be paid in the next 7 days or they leave you no alternative but to take further action.

    Do as Sarah has suggested.

    If necessary you can pursue this claim via an employment tribunal completely free of charge but you MUST file your claim within three months of leaving.

    You could also use the small claims court but you would have to pay a fee up front (which would be added to your claim).

    In practice, via an ET, ACAS would contact the firm and basically tell them they don't have leg to stand on.

    You can get the money but you may have to work at it!

    Do they have to pay me for the 'trial' I did then, because they were saying I wouldn't get paid for the trial even if I did work the weeks notice.

    That is more debatable. I would include it in your claim. I would suspect that when they find out that legally there is no requirement for notice they will just pay the whole lot.
