info am i after too much

Hi all

Well i finally decided to put my house up for sale last saturday. Signed the contract etc with estate agent on the same day as not around much. I was told pictures of my house will be took Monday or tuesday fine as i wasn't around and they have a key. I Came back to my house wed night and about 10 am thurs morning someone trying to get into my house the photographer . I had informed the estate agent i would be back thurs. A curtosy ring of the door bell would have done. I then leave my house and the photographer says he has the key will lock up etc etc. I come back approx a hour later luckly i had as they had put the alarm on and not locked the door ,not very good as i am rearly at the property luckly i was yesterday . phoned estate agent went mad as you can expect was assured it wouldn't happen again . Bought local paper which has all the property i n it to find on easter weekend they are the only estate agent in the town not to have a advertisment. Checked website still no information on their. AM i expecting to much to much from them or am i right in thinking that at least they should have put some info on their site. Or do you think they are less interested as i am going away even though i have solicitor ready to instruct a mortgage in principle in place .Having really bad feelings about this company. They are a well established family run company been around for many years . I am now quiet concerned as i am due to go away for 2 months in just over a week. I do have family who keep an eye on the property but can't expect them, to keep going up and checking that the estate agent have locked the doors etc.

Any advise on how i should proceed with this as if house moving isn't stressful enough. Or have i just been unlucky .

  • I wouldn't trust them one iota!

    For a start you need to get to them asap and take your keys off them.

    Don't worry about the contract you signed with them since on signing and in having your housekeys they undertook a duty of care to look after your property for you in your absence. They defaulted on that contract by not locking up and not resetting the alarm.

    That is without the rest of it.

    If you feel that you must stay with this scary Company, I would be giving the keys to a family member so that one of them can be there if someone wishes to view the property. The EA has already established that they cannot be trusted with your home.

    In my opinion you need to be out of that contract quicksharp.

    If nothing else you can talk to a legal adviser free of charge at the CAB re the contract.
