Rights to working for a competitor

Hi all

ill make it quick!

Recently left a job after only 4 months. In my contract of employment i signed to say i wouldnt work for any other company within the industry within a certain mile radius for a period of 12 months. Stoopid of me becuase now I have the opportunity to work for a competitor.

Whats my rights? do i have any?

  • It is much more complex than that.

    Anti-competition clauses are enforceable as long as they are reasonable but there is no simple definition of what is reasonable as it depends on what exactly you do, what info you would have had access to, what the mile radius is, what other opportunities there would be for you were you to obey the clause, what remuneration you had/ have to compensate for the clause and how termination is handled etc (eg garden leave) etc etc
