Tax Credit overpayment - can it be included in a DRO?

hi all,
quick question to you lovely helpful peeps.
i'm currently in the early processes of getting a DRO through the CAB and have received a letter from HMRC stating that i and my ex owe £270.00 (approx) I can't see how this could be the case but before i go through the lengthy and stressful process of arguing this with them i wondered whether this debt could be included on my DRO? TO save my mental stability....?
As it is in my name and my ex's can i put the whole amount on there?

I believe benefit overpayments can be included - and that would I guess fall under that category (from here http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=37_debt_relief_orders#chapter5).
I think you would need to include the whole amount (but that if you enter a DRO ex will become liable for it all).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

I received a tax credit overpayment notice and telephoned the HMRC. I told them I didn't have the money to pay it all at once (it was approximately £1,300) and I asked if I could pay it in instalments. I have it set up to pay £50 per month and it finishes in January 2014 - and its interest free. They were very helpful and sent a letter confirming our arrangement. I'm not sure about the situation with regard to the DRO, but I am sure someone else on here will be more knowledgeable.0 -
Thanks for the quick reply. If my ex becomes liable for it all... I predict problems, as the tax credit payments always went into my account. but i suppose then that's for him to worry about not me. But I don't think like that I just want to find a clear solution to all this mess. It's so hard to keep everyone happy. *sniff* I'm exhausted0

Smurf... if i had any money left in the month i'd consider this too. hence the DRO. I'll see what CAB think when i next see them to go through the forms. Thanks for your reply x0

Its a really stressful thing to consider a DRO or bankrupty - but if its right for you and once you have got through it I bet you'll sleep better than you have in ages.
