Wrong Information On HP Agreement

  • maybe true what your saying, But this salesman has either commited fraud by lying to the finance company, Or breached the credit consumer act. although it is late, Its just been uncovered.

  • No the credit agreement has no signature of it, And for the record, as stupid as this sounds on my half, I was kinda excited to be getting a newish car and it was my first on finance, I did not read as much as i should have and just signed on the dotted line. I have been intouch with the FSA regarding this matter today, i was advised to go to the main dealer to see if they can sort the problem if not then to go back to the FSA and open a complaint, This takes 8 weeks though.

    What I suggest you do is put your complaint clearly and concisely in a letter to the dealer outlining what action you would like them to take and a deadline with which to expect action or a response. Send it recorded so you have proof of delivery.

    Then refer to the FSA if they fail to remedy it.

    Please do post your letter up here if you want some help on it.

    You do need to be clear about what you want them to do, a generic complaint may get you an apology etc but unless you give them a prod as to what you want them to do you may struggle to get anything.

    Just fot the record, Go look on auto trader or something and look for two of the same cars with around 30k miles difference, youll see what im taking about. you as a buyer would not pay the same for a golf had it done 100k compared to a golf that had done 50k.

    I was looking to get a new car, This is how it has come about, I.e me going through the paper work. When i mentioned it to him on the phone today he said he will put me in a new car and get me out of this one, But i will carry too much money over to the new car due to thr price im paying n this one. And the only reason im paying so much is because the finance copany paid out on a car they thought was half the "used" car it really was.

    You have a point but the car on the finance would have been at a higher value than the car you actually bought.

    You paid a price for a car that had done 68k miles and got a car that had done 68k miles.

    The cost of finance is a separate issue.

    i have yes. But would the finance company had paid out had they known the true miles on the car?
  • Let me answer that question with a question: do you want to keep the car?

    They may not have funded the purchase, but they did to enable you to get a car. If you pursue that argument you need to be prepared for the whole deal to be unraveled which would mean you giving the car back.

    No. I want a new car, i need a diesel car. Im happy to trade this one in and carry some money over to a new HP agreement, but now i have found this out, i want to make sure i am not paying more money back on this car due to the finance company paying more out for it than it was worth at the time due to the miles different.
