I have an outstanding debt with a private company which was passed to a debt collector (Daniel Silvermans) without prior notification. I agreed to pay £20 per week, as this was the least they would accept (against about £3K), but this was a struggle and I admit to missing a few. The debt was therefore passed to another company (Culpa Legal), again without prior notifcation. Culpa wrote to me and told me they had taken over the account and I was to make no further payments to Daniel Silverman. I wrote to Culpa to request a payment agreement and they phoned and said they would look at this. I heard nothing from them so wrote again in October, November and January. Again I heard nothing.
Yesterday I received a letter from Daniel Silverman (the first company) saying someone was coming to see me to talk about legal action because I had stopped paying and had ignored their letters. I rang them to say I had been told by Culpa not to pay them and had heard nothing from either company for months. Was told that Culpa had gone bust and the debt had been passed back to them by the company I owe.
I am quite happy to start paying off an agreed amount again, but am worried at their threats of visits. It's being really badly managed and I am worried that the bad management may result in court action or someone standing on my doorstep.
Does anyone have any advice?

I would write back to David Silvermans (by recorded delivery) saying that you stopped the payments because of the letter from Culpa (send them a copy) and that despite writing to them on X number of occassions you never received notification of how to pay, or that they had gone bust.
Say you are happy to set up payments again with David Silverman, and ask them to send you the relevant forms. Make sure you keep copies of everything, and if you always write by recorded delivery you've got proof that they've had your letters. Hopefully it shoudl all come out in the washTotal Debt 13th Sept 2006 (exc student loan): £6240.06 :eek:

You don't have to accept them coming out to your door. You can instruct them to only contact you in writing.
If it does ever go to court this could be a good thing as provided you are being reasonable & can show all of your income & outgoings the court will not expect you to pay more than you can afford.0
