Thanks. My Neice and her friend and previous tenant are going. Two others are unable due to the lateness of the summons to attend. The difficulty with making a payment online, is that they don't owe £1000 as they were only there for 4/5 weeks.Given the time of the hearing it seems unlikely that anyone would read an email, well thanks anyway.

this post indicates that there were at least 5 people living in the property who are not related to each other this could/should mean the house is a HMO (house of multiple occupancy) making the landlord responsible for council tax
I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

Thanks for your responses. A quick update is, my sister says her daughter has text to say,"Everything was fine, they made loads of mistakes,I'll call you this evening".

It could well be that this would have been an HMO as you say hallowitch and that could be where the problem stems from, but I'll know more later, but it all sounds fine thankfully.
    Will give fuller details later.
  • Thanks nad1611 - ive been eagerly awaiting an update, and had my fingers crossed for you all day - glad it went well!

do you know if the application for the liability order was withdrawn

make sure they get everything in writing from the council and a conformation letter to say that they hold no liability for council for the (Address ) and tell them to keep it safe for years (ever :rotfl:

Hi All, when my neice arrived with her friend, the Clerk told them that there was no case to answer as The Council had realised they'd made an error and hadn't documented the fact that there were students living there. They will have to pay the outstanding from the end of term which was about the 7th of June until June 30th, when they moved out, so not even a full month and a lot better than the £1000 Summons!!! Especially as it's between four of them.
Thanks for everyone's interest and help ;)

    Hi

If this was a house in multiple occupancy (for CT purposes) then the landlord has to pay the Council Tax, not the tenants.

They need to check that out before they pay anything.
If you've have not made a mistake, you've made nothing
