Claiming ESA after accepting a compromise agreement

OH has accepted a compromise agreement because of disability discrimination. Is currently signed off work and will still be when leave the job for probably another 4-6 weeks while they continue to recover from an operation.
Will they be able to claim contribution esa and then go on jsa when fit to return to work?

Yes and yes providing he has enough NI contributions for contribution based or low enough assets for income based.
You can get contribution based ESA (if medically eligible) after 26 weeks even if still employed and getting company sick pay.0
