p45/tax help - UK

Hi all. I hope this is the correct section and that you can help me.
I was working for a company for about a year until Christmas time when the directors of the company fled the country to avoid going to prison without giving any warning to anyone. I am owed over £1000 (but that is another story). Because they fled so quickly I never recieved a P45 although I do have lots of payslips.
I recently went to a job agency and have been working for a company for a few weeks. I see that the tax code on my payslip says BW and it seems to be stealing a good chunk of my paycheck
Questions for the clever people:
1. Am I on emergency tax?
2. What steps do take to fix it and to claim back any money on the tax i have been paying since at this new job?
3. If I was to leave the agecny, I assume the agecny would give me a P45. Would that then mean that I would be back on a normal tax code in my next job?
4. Is there anyway I can get some money out of the scumbags who shafted me in my last job?
thanks.

No, you are on Basic Rate, no allowence, 22% of everything you earn
2. What steps do take to fix it and to claim back any money on the tax i have been paying since at this new job?
Not sure about this but as you have payslips I would say a fair change of reclaiming any rebate owed. I would contact MNRC direct.
3. If I was to leave the agecny, I assume the agecny would give me a P45. Would that then mean that I would be back on a normal tax code in my next job?
No again, your P45 would only state the code you are on now (BR) and that it was would transfer to a new employee. Your best bet now, being that it is a new tax year is to complete a P46 which should effectivley put you on an emergency tax code (providing this is your only job and you have no other income. 522L, you should be in time to get this on a cumlitive basis. If you left the ancency AFTER this then if would be reflected on your P45.
4. Is there anyway I can get some money out of the scumbags who shafted me in my last job?
Doubtful  Try CAB
thanks.

Hello

You can download a p46 form here http://www.hmrc.gov.uk/forms/p46.pdf then fill out your bit and give it to your employer to complete.
If you're lucky, you may get any tax owed to you in your wages.. otherwise I think it will need to be claimed back from the inland revenue.

It will be unlike that your employer refunds any tax as any owed will now be for LAST tax year
HMRC and pretty good though at getting the refunds out :j
