Four year contract ???

The company i have worked for 17 years has recently been sold to a large competitor,they have offered me a four year contract,which takes me to 60 years of age.

The contract states after the four years,three months notice from either party would terminate my employment,the issues ihave are ,
Will i be entitled to redundancy if the contract is terminated after the 4 years
If within the four year contract,the work drops of,would they have to pay me for the full four years

    That would depend on the terms of the contract, i would doubt it though.

    That would depend on the reason for termination being redundancy.

    You have continuity of employment ask them why they think they need to use a new 4 year contract whats wrong with the one you currently have.

    Any termintion should be as if nothing had changed anyway.

    Watch out for them trying to retire you.


    What is cuurent notice and the notice during the 4 years on the new contract.
  • I would imagine if the work dries up before the end of the 4 years they can make you redundant like any permanent contract.

    If they give you notice after your 4 years you would not be entitled to anything.

    If your employment is being continued under TUPE, you should not have to sign a new contract as all your existing employment terms should continue, including your permanent contract rather than your fixed term.

    Standard termination rules, like redundacy apply.

    You can't just not renew.

    Normally yes. However it possible (although unusual) to have a fixed term contract which guarantees work for that period of time.

    Not so. Done properly you would have no claim for unfair dismissal but it is still a redundancy situation so a small amount would be due.
  • Ask them why they will not continue with your current 17 year contract for another 4 years? Or do they know that they will be making redundancies already and are trying to limit their liabilties in this area?

    Hi Guys, Thanks for all the replies,they have put on the contact that i have 17 years service for TUPE reasons,but it was my idea of a four year contract because the type of business i operate in a personal client contact which i have now done for 35 years in total.
    I was concerned that they would try and take my contacts then make me redundant, i was of the opinion if i had a four year contract they would have to pay the contract up if that was the case.I have negotiated a very good salary which actually advises on the contract it is for a minimun four year period after which three months from either party would terminate it
