Still getting paid after leaving

I worked for my last company from the start of April up until the start of June when i was asked to attend the office to be told that i would not be able to continue my position as i had failed security clearance, i was given nothing in writing and was told verbally that i would be forwarded my p45 and any wages owed.

The following month i still had not received a P45 and the company paid another months wages into my bank, i phoned up payroll who said as far as they could see i was still employed hence the lack of P45. The man i spoke to said he would chase it up and rectify it.

Then the next month still no P45 and another months wages into my bank so i called again and spoke to the same person who confirmed they had e mailed my former manager and it should have been rectified, i expressed my concerns of my P45 missing as i was starting another job and the guy from payroll advised me to just fill in a p46 until my p45 arrives and said he would contact my manager again.

As i had not received my P45 with pay day approaching i e- mailed the company explaining the overpayments and the correspondance with payroll department, but despite this they have paid me yet again!!

On receiving the last wage i have sent them another e mail giving them 7 days to respond, the 7 days is up and i still haven't heard anything.

I would think that they cant be receiving my emails but the fact that i have spoke to someone in person just makes me wonder.

From here i dont know where to go?

Any advice?

    Put the money into a high interest savings account until they ask for it back. With regard to the new job just fill in the P46 as advised by the HR person.

  • Thanks thats a good idea about the high interest account, that could also go in my favour that ive put the money aside so as not to spend it, the problem ive got with the new job is that my previous employer are paying my tax and i am not paying any on my new wage, am i likely to get hammered next april when HMRC see ive been getting two wages?
  • Note also - make sure when you pay the money back that the P45 given does NOT include the over payments.

    There is no record they terminated your employment.

    Send in a resignation letter giving notice.

    That should stop things, let them chase up a refund.

    The OP didn't resign though so should have no need to do so. They let the OP go so they should have something on file.

    I would not suggest resign when the op didn't.

    Like previous posters have said just draw out the cash they pay you and hold on to it till they ask for it back.

    If the OP has told them twice what more can they do? The employer are making the mistakes and it for them to stop paying the OP.

    By resigning you formaly close the employment get a P45 and set up a state where they may never request the money back, they have no records they terminated

    The person that should have processes the termination may then may decide to keep their head down and do nothing.

    starting a new job so not a problem
  • Thanks everyone for the feedback, ive decided to put my notice in today as i have nothing to lose, be interesting to see where this goes from here.
    I wonder if they will give me any holiday pay im entitled to in my last wage?(joke)
