Benefits stopped- ex-employer lying about reason for leaving

My brother in law was laid off by his employer after a few months in a new job, as they said it wasn't working out. He was simply called in to the office and told that he was leaving with immediate effect.



He then signed on, but has since received letters from the DWP advising his employment benefit has been stopped and also the council, who have stopped his council tax and housing benefit. He is now in a position of having to apply for hardship to feed and house himself, my sister and their two children.



Both cite the reason that his ex-employer has told them that he was sacked for gross misconduct. This is a blatant lie as a) there was no process and b) they didn’t tell him he was sacked for any reason, let alone gross misconduct.


He is going to appeal the decision, however would appreciate any advice on how to best handle this. We can't find anything that specifically advises around an employer stating false information on an ES85JP form.
