he was told resign or be sacked, and I guess he thought resigning looks better overall, so in effect he had no choice.
Fact is this does go on all the time.
Presumably there is no formal agreement in place so unless he really believes that they will provide a good reference he has gained nothing from this. "Resigned whilst under investigation for XXX" reads exactly the same as "dismissed for XXX".
He will now find it much harder / impossible to make an unfair dismissal claim (assuming he had any reasonable grounds) and may well find JSA is sanctioned for up to six months.0 -

It didnt go well, they forced him to resign. He went in fighting, but they refused to listen, wish he had just gone sick for a week or two..
Upset for him, obviously, but not sure there is a lot he can do now, he will be paid for one more month but is not in the building.
Went in fighting but then rolled over.
If he had allowed them to sack him he could have found it easier to take them to an ET if the dismissal was unfair.
Did he take anyone in with him or was he on his own?0
