Old debt, credit score and debt colecting agencies

Hi all,

I am not sure if this has been posted in the correct place but here goes ....

I had a mobile account that defaulted dating back to 2007. It went to debt collection agency who offered a reduced settlement figure to clear the debt. I paid this and thought that was that. I am in the process of trying to mend a badly tarred credit rating and in investigating have discovered that the mobile account is showing as an active default and that I still owe them £76! I was under the impression that once a debt goes to debt collector u no longer owe the original company any money as it has been 'passed' on to the debt collectors. After speaking with the mobile company I was told if you want to clear this u can pay the £76 as we are still out of pocket! I asked them how this was legally viable and she said its how it is.

Is this true? I no longer have original paper work from debt collection people but if they offer a settlement figure to clear the debt then surely I dot owe the original company any monies?

I am at the end of my tether and considering seeking legal action if i am right but wanted some advice first.

    Legal action? I think it maybe cheaper to pay the £76.

    After 6 years it should drop off though. But i think it depends if they sold the debt or the collectors were just working on behalf of the original company?

    Did the debt get transferred?

  • Thanks for reply, I couldn't tell u if it was transferred or not to be honest. It was forgotten about until I looked and saw this on my file!

    Maybe I have misunderstood the way these kind of debts work.

    If no-one is chasing you for the £76 then the debt probably has been written off. The only problem is that the debt has not been written to zero with the CRA. Is this the case with all 3 CRAs or just some rubbish on Noddle?

    Without original paperwork, it's not really worth digging this up.

    The entry drops off in 2013 regardless.

    I had the same problem with Vodafone some years ago. I presume you have some access to your credit record so the simplest thing to do would be to contact either Experian or Equifax and challenge the information.

    I did this with the Vodafone one and, although in my case I had paid in full, it was removed within a month.

    Defaults are generally peculiar to Mobile phone companies and they can be seen as worse than CCJ's by some lenders. The irony is that a Mobile co doesn't need to go to the hassle of taking you to court to put one on your record.

    You have agreed to settle on a figure therefore even if there is something outstanding the mobile co should remove it, thereby honouring their side of the agreement. Don't give up until you get it removed.

    Like someone else said earlier it is near the 6 year mark and therefore should drop off, but I wouldn't rely on that, be proactive.
