CCJ redetermination

My hubby has asked for redetermination on the CCJ Egg are slapping on us, Can I go as his representative as he has to work? We have been told that it is better to go.
They have accepted the payment of 51.00 per month on one but want 315.00 on other, which is only 200.00 more! does this make sense to anyone! you think the judge might have noticed the big jump.:rolleyes:
Any advice welcome.

    I see absolutely no reason as to why you can not represent your husband in court, although I do think it would be better if he can take time off to attend himself.
    May I suggest that you take a signed letter, from him, giving you the authority to speak on his behalf.
    A Court should not impose a payment order which you can not meet, so taking a detailed SOA might also help.
    It is possible that Egg, or the solicitors acting for them, will try to come to an agreement at the Court, before you go to see the Judge. This usually happens when they know that they are on 'shakey' ground. Stick to your guns and do not offer more than you can afford.

    We are going thru CCCS and have sent then our SOA and a list of creditors more than once, don't really understand why they are taking this route we have never missed a payment although they have been reduced since Oct and compared to other DFW's don't seem to owe that much.
    I was going to take everything I have, a letter is a good idea, thanks.
    He has tried to get the day/morning but his company aren't very flexible and he is really embarrassed about all this and doesn't want to tell them why he needs time off, although he didn't mind spending the money in the first place!!!

  • Hubby went to court and was given a CCJ and told to pay £58 per month, this was more than he could have afforded but he has paid it this month and it's going for a redetermination. The judge was an absolute jerk, he wouldn't even take into account his DMP and the fact,. like you, the card company hadn't missed getting a payment, they were just greatly reduced.

    Take an SOA didn't help him and it was so aggreviating.

    I do hope the judge overseeing your case is a lot more sympathetic than hubby's.
