Hi
I worked a week at a primary school as a teaching assistant I fell ill and went into hospital. I stayed there for two weeks. I texted the manager and he text back "ok". I go back to work and I am told that someone else has taken the job sorry.
I didn't sign a contract yet. I have no badge or anything to prove I worked there. I have only the hours timetable with my name, job and school name on.
HELP what can I do?

What terms were you taken on,
Any paper work with notice periods on them also the sick policy?
An offer lettter what was in that?.
THey may refer to a handbook or other documents
Without anything to show otherwise you will be on statutory terms regarding notice and sick.
With less than a months service notice can be immediate(without reason).
They do need to pay you for the 1 weeks work and accrued holidays up to the day you were told you no longer had the job.
if there is contractual notice they also need to pay this.
Not sure on the sick time and if you qualify for SSP or any contractual sick pay0 -
When did you fall ill and when did you text your manager? Did you speak to anyone at all?If you haven't got it - please don't flaunt it. TIA.0

No paperwork at all. It was a verbal agreement to be signed later.

No offer letter.

I started on the Monday and worked until the Friday. I fell ill on the next Monday having worked five days. On the Monday I fell ill and went into hospital. On the Monday I text the manager.SECRET OF SUCCESS IN LIFE:

Absolutely nothing you can do I'm afraid.
Legislation is that they can 'let you go' for no reason whatsoever in the first 2 years of employment.
Hope you find something soon.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
I think part of your problem may also been sending a text instead of calling and speaking to your manager.0

They owe you acrued holidays for 3 weeks.0

When on the Monday did you fall ill?
When on the Monday did you go into hospital?
When on the Monday did you text the manager?
What time were you supposed to be in work?
If you should have been in work at 9am [say] and fell ill at 6 am [say] and didn't text until 5pm [say] then you were absent and as such, in real terms, failing to fulfill your contract. If you haven't got it - please don't flaunt it. TIA.0 -
McKneff - that isn't true. I realise full employment rights only accrued after 12 months (and now after 2 years, for jobs which started since April 2012), however, dismissal can still be unfair.
OP - were you working full-time and did you receive a P45 with your pay, or any letter confirming dismissal?
I'd write to your employer, asking whether and when a disciplinary hearing was convened (in your absence) and for a copy of the decision and for a copy of the school's employment manual.
Keep it polite; but, reiterate that you did inform your employer you had been hospitalised. The seriousness of the same, may mean the school had to take on cover, as you may have been in hpospital for weeks/months.
I assume the boss will deny having received your text, so keep the same.
They may ask for proof of any hospital attendance, so you may want to write and ask for this. Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.0 -
