We need to stop the increasingly compensatory culture in this country and a limit on employment tribunal payouts is very welcome. Also welcome is the dropping of plans to allow easier dismissals - UK legislation on this is already very liberal compared to most European countries.

not quite sure who the govt is going to limit settlements between staff and companies. who is going to complain about a settlement being too high?! the horrid company X agrees to pay bloggs £100,000 to go away. neither bloggs nor horrid company X are going to report the "illegal" settlement.0 -

If the settlement is private, then it's a matter for both company and individual. The limit is on tribunal settlements only.
It's good news because it will discourage vexatious litigation and encourage private settlements. However, if you are a lawyer, maybe not such good news... :rotfl:0 -

there is no such thing as a "tribunal settlement" as far as i know.
i'm not sure if the article has been amended, or i just misread it, but i think i got the wrong end of the stick anyway as it just says:
"He also wants to bring in settlement agreements, in which staff agree to leave without being able to go to a tribunal, but get a pay-off in return."
Wow, Vince Cable has invented settlement agreements. Errrr. Haven't these been around since, basically, forever?0 -
one wonders how many settlements are for more than a year's salary?
and what exactly is stopping employer and employee agreeing a settlement to leave?

Well, in many alleged discrimination cases the payments have been for huge amounts. This nonsense needs to stop.0 -

Let's say that a doctor at staffordshire hospital had blown the whistle on the appalling treatment of elderly people there.
Now let's say he was sacked and became unemployable.
Should he/she be entitled to a huge amount of compensation as his career has beeen effectively ruined or would three months salary be suffice?0 -
