Old system CSA - advice please

My ex partner pays via the CSA £300 a month for our 2 children. It used to be £400 a month, until he got married (his wife had 2 children, but not with my ex) and moved house, and because of the new mortgage, he was able to get the maintenance reduced (not because of her children, as he is on the old system, but was because his housing costs had gone up).

Ive just found out that he has now split up from his wife, and as i havnt had a raise in the CSA payments for nearly 4 years i was thinking of ringing them and seeing if there was a chance of getting an increase. If i do this, will it be transfered onto the new system, or will it stay on the old system, and does anyone know if there is any chance of it being increased, as i dont really want to bother with the fuss if it wont be, it could cause too many problems in the long run, mind you, he hardly ever sees the children (his choice) and wont pay anything else for them as he pays CSA - i wish £300 would cover half their living costs!!!!

£300 is a reasonable amount of money, you could put in a review and they might decrease it, its up to you but I personally wouldnt rock the boat

The assessment could go up or down. It depends on what his circumstances are. If his housing costs are lower then it may go up, but if his wages have decreased since the last assessment, it may go down! The crux of the matter is the housing costs - if you can find out where he lives and how much he pays, it may help you decide.

You will remain on the old system I'm afraid. The only way you get transferred is if somebody else claims against him or you have a new claim against another partner.

Or if you close the case for more than 13 weeks and then reopen it.

Yes of course - but there are risks here too because many cases get stuck and it can take many, many months to get it going again and no money is going anywhere!

The PWC can make a judgement on how much she is likely to get if she has an idea of his weekly income. Provided he earns more than 200 quid per week, then it will be 20% of his net income - which could be much less than he is paying now, or it could be more - only she knows that. But for the 13 weeks there will be no liability from him at all. If you mistakingly re-open the case even 1 day too early, it will link to the old system rules, so you would need to make sure you get the dates absolutely right, or leave it longer to be sure.
