Subject Access Requests-experiences

Hi all

Thought it might be interesting/useful to share experiences of SARs and the subsequent results. Especially for accounts not running as smoothly as they might :)

I submitted 4 on 31 July:

MBNA.
Reason: to see if they really had my CCA and to pee them off.

Result: cashed cheque quickly. No letters. SAR pack received 10 sept with no CCA as they dont have it and a load of stuff of no real interest.
Nice of them to send all my personal info not signed for though.


RBS
Reason: PPi on previous loan that I was told I couldn't have if I didn't need it. Naive! But probably too old to claim on as about 10 years ago.
See if they do have my real credit card CCA not the pathetic excuse they claim is it.
To pee them off big time.

Result:
Not a sausage. No cheque cashed. Zip. Sent follow up o branch asking why they haven't responded.


Shop direct:
Reason: they annoyed me.
Result: letter dated 5th sept saying they are looking into it. Cheque cashed. Not looking good for getting anything within 40 days.


Marbles/whoever owns them these days:
Reason: really have CCA? They say they don't.
To pee them off.
Maybe PPI in the early days.

Result:
Cheque cashed. Letter saying of course they will send it within 40 days.
No sign of it yet.

    HSBC. Sent with a postal order and signed for on 23rd July. Nothing back, so a chase letter sent 6th Aug. By return "thank you for your DSAR. Unfortunately we are unable to process as the signature does not match our records".

    Presented myself to the branch with ID and letter. Phoned them to confirm all was OK and that they had the original request. All good apparently.

    Today - "it seems we did not receive your original letter. Please re-send with another cheque for £10".

    Fuming here and looking at starting all over again. Despite the proof of delivery.

    Ouch. Not sure if these fall under the FOS complaints process. Suspect it's ICO. I Might need to find out soon :)

  • I had a horrible experience with Shop Direct also. I had a Littlewoods account a while ago. I requested my SAR in June 2012 and I also sent in a copy of my proof of address and I even went into great detail on the letter to say that I've changed address. The next thing I know they sent a letter with my account into to someone at one of my old addresses under a very similar name but not quite mine. I rang and complained asap. This happened 56 days after my request. My actual SAR didn't arrive till 72 days later. Every time I chased I was told that there was a backlog or the the woman dealing with it was on a break. Very poor and I would hope that with information as sensitive as a SAR that they would at LEAST double check the address they are sending it to, to prevent any potential identity fraud. I'm fuming with them.
  • I sent in a SAR to Halifax regarding negative markers incorrectly applied to my account. The information was due for delivery on 15th September.

    Nothing in the post this monring... I'm not hopeful either, although they have cashed the cheque and acknowledged it all in writing.
    Some days, it's just not worth chewing through the leather straps....

    Well, RBS one turned up today. Not cashed cheque. Covers only credit card, not previous mortgage or loan or current current account.

    Arrived in an open envelope, supposedly sent signed for. Think the damage was postie wedging through letter box.signed for it too.

    Has no application form as it Says don't have it. probably true as 20 years ago.

    No sign of CCA. Or no mention of reason not included.

    Complaint time at the weekend as they fobbed off my CCA request with a poorly not proper recon. (Text removed by MSE Forum Team)

    Nowi have another 6 years of statements to shred :)

    I wouldn't shred anything until you have confirmed that there are no unfair charges or PPI to claim back.

    If you included the requirement in your request for the missing accounts data, complain to the ICO as well as them.
  • No PPI on this. I did have on a loan over 10 years ago when they told me no PPI means no loan. Car loan and I didn't need it as long contracted job. If I only knew then what I knew now...

    Had a letter today saying mine is in the branch ready to collect. The letter warns the box is heavy and I might need some help lifting it... LOL - I might be quiet for a while now...

    For the record, they received my request on the 23rd June. 104 days.

    Got my marbles one last week sent by DHL. At least it was secure if missing anything of use. Complaint submitted.

    No sign of shop direct one. Interesting that the 'we are working on it' letter mis-spelt my surname. Deliberate? We shall see
