Evans Store Card

My wife has an evans store card, the account is paid by direct debit. The payment due date on the statement, was the 27th of August. They requested the payment on the 24th, but her wages were not due to be paid into the bank until the 25th. Evans have now added a late payment fee and sent a letter stating the usual bull. I phoned the call centre, complaining the payment request was to early and the reply was, by law we can request payment up to 7 days before the due date.
Is this right?
Any help would be most appreciated.

Can you cancel the direct debit and pay them by direct bank transfer? If they accept Faster Payments, it is in the account in 2 hours so you could actually pay on the date that the bill is due but would check this out before trying it.LBM 10/1/12 ~ DFW Start 6/2/12: £82,344 ~ Now Zero:staradmin:starmod::staradmin Debt free 17th April 2015 :staradmin:starmod::staradmin

Makalu, I think it's been pointed out elsewhere that it is your responsibility to make sure the money is there on time - you have chosen to run up the debt.
In this case, the funds would have been there had the company presented the debit on the agreed date. Marky, I would suggest you call back, and politely ask for a supervisor. Explain that the salary payment was in place in time to distribute funds on the date listed of 27th. State that you were not away that they could take the money that early, and ask politely that they waive the fee in this case, since the early deduction was the only reason for the problem.
If you ask someone higher up nicely, you sometimes get results. Some days, it's just not worth chewing through the leather straps....

You took the card out it is hardly their fault if you don't have enough in your account to cover the monthly payment by the date due.
Maybe a good idea to make sure there is enough money left in your account from the previous months pay so that there is no late payment fee.0 -

On the statement with the 27th on......does it state the direct debit will be taken "on or after 27th August" if so...then ring them back and state that it says on THEIR bill that they will take their money ON or AFTER the 27th and not before!!:jEngaged 25/12/11 :j

My capital one direct debit goes out about 3 days before the payment due date. My statement does tell me this though and there is a separate date the direct debit will be taken on my statement as well as the payment due date. Something similar could be going on with the OP
I'd suggest going through the statement with a fine tooth comb to see if this is the case or not0 -
Obviously the 27th was a Bank Holiday, so they took the payment on the working day before that, but usually it's the day after, so I do find that odd. You say your wife got paid on the 25th, but surely the funds would of been paid into her account on the 24th as she was being paid on a Saturday? Thats what happens with my wages as i'm paid on the 10th of each month. Unless she is paid in cash?0
