BRO - Does it stay on your file longer then a normal bankrupcy?

I declared myself bankrupt 4 years ago and was discharged last December.

I had a bankrupcy restriction order put against because I continued to use credit cards with no way of paying back the full amount. At the time I didnt dispute it as I just wanted it over. I am kicking myself now as I think I could have had it removed.

Does it stay on file longer then 6 years. What else does it mean differently for me?

    A BRO can be set for anything between 2 - 15 years. You should have been told the length of your BRO?

    The date should also be on the Insolvency Register.

    Hi Laura, BRO's and BRU's will now stay on your CRFs for a MINIMUM of six years from the date they are awarded.

    So, for example

    You go bankrupt on 15/5/2007
    BRO/U awarded for 5 years on 01/5/2008
    Your bankruptcy will fall off 15/5/2013
    Your BRO/U will fall off 31/4/2014

    If the BRO is for MORE than 6 years it will remain on your CRF until it has expired, but will then fall off immediately.

  • Thanks, the BRO was for 3 years so ended in December. I guess I have another 5 years, 3 months until its off my file.

    Too late to challenge it now!

    No you have another 3 years left........December 09 BRO given so six years from then it will drop off December 2015 :beer:

    BRO/Us stay on credit reference agency files just for their duration, so yours should be gone by now.

    But the the actual bankruptcy will still be there for 6 years from your BR date. Your credit record it pretty screwed just from that, BRO/U or not, so the lack of BRO/U is not a huge deal.

    Ahhh I was just going by what Tim had posted, when asked about BRU/BRO's

    And this time it looks like it wasn't the creditors who asked for this, it looks as if it was the Insolvency Service, as they felt that if a BRO/U is awarded then it is for reckless behaviour, so should be highlighted for the normal reporting period of 6 years minimum.

  • Thanks both. I have just checked the register and I am no longer listed!

    I have recently tried to get a credit card with low limit to try to build my rating up but was declined. I got a credit report and it was still showing old debts that were taken into account on my bankrupcy???

    The Insolvency Service also sends us details of bankruptcy restrictions orders. If you are bankrupt, the court may make a bankruptcy restriction order against you if it decides you have been dishonest or are in some way to blame for your bankruptcy. We hold these records for as long as the court order lasts, which can be up to 15 years.
    Which as far as the CRAs said when I asked, means it comes off when the BRO/U ends. 6 years or not.

    I still could have been told wrong though.
