    It is much simpler if employers match the statutory requirement or better and forget X+BH.

    it keeps it simple, for a full timer on statutory holidays you get 28 days and the standard rules apply an employer can say when you take them, so can prealocatate the BH or ask you to book them etc.

    Part timers, part years for starters and leavers, maternity and sick are easy to administer and it is easier to explain to all but the most stupid.


    With the X+BH you need a policy for when people work the BH, this could be TOIL, or or something else that will be complicated to get right. the prorata rules also get a bit messy since people tend not to understand that BH need to be prorata as well.


    As a change this is likely to be the one not to worry about(as long as the total is the same), it is the ones you think are allright you need to worry about.

    You have never had a statutory right to Bank Holidays off. In the law, AL and BHs are not treated separately - you have X amount of paid leave, and your employer can tell you when to take it.

    It seems your organisation are now exercising that right, rather than saying you can automatically have BHs off. Annoying it may be, but just book them in advance.

    As long as your total PAID holiday for the year (BHs and AL) is the same as before, I don't see it's an issue. :)

    Secondly, the business is closed on Christmas Day so I couldn't work it even if I wanted to. I pointed this out and asked what would happen if I didn't book it off. I await their answer...

    So, instead of (say) 20 days AL and 8 BHs, you have 28 days' leave.

    In your old contract, Christmas Day would come out of the 8. In your new contract, it comes out of the 28. It's no different.

    Thirdly, my boss said that this is no different to my original and current CofE but worded differently. In my current version it states "You are entitled to x days annual holiday plus the 8 recognised UK Bank Holidays".
    To me, that clearly says that those 8 days are mine to take regardless and no mention of having to book them as holiday.
    So I suppose the question is (based on the wording in my current CofE); has the requirement of booking of Bank Holidays been added?

    Yes, they are simply saying that you have no entitlement to BHs off - you have the same amount of paid leave (or you should), but instead of forcing you to take 8 of them on BHs, you actually have more flexibility. Ie, WORK the BH, and use the holiday for another day instead, one which might be more convenient.

    You actually get more flexibility out of this, and it's standard practice in every organisation that doesn't always have BHs off.

    The employer can tell you when to take some or all of your holiday: if you don't book it, and they're not open, they'll treated it as booked holiday, IMO.

    When I prepare our leave booking sheets each year, I list the bank holidays and book them out as leave. If anyone wants to come in they have to unbook it through their line manager.

    you have 28 days holiday a year, if you work for nice people you take bank holidays extra. Where I work it is 28 incl bank hols so please Mrs Queen don't go giving any more BH cos for the last 2 years I have lost a day out of my holiday allowance grrrrrrrrrrr
