My company is trying to get rid of me and using any excuse!
I worked on a site for 4 years and 1month from end date the site manager makes complaint and now I am under disciplinary.
I took 2 week holiday and on day I returned from holiday I got call not to return to site & I am suspended pending internal review. 2 weeks later I receive letter and report asking me to attend disciplinary interview next day. The report was all one sided and basically accusing me not attending site the required 46 hours per week. The site has electronic swipe system that tracks your whereabouts but problem is it does not cover all the site and my hours on the system thus they claim I am frauding the company and under gross misconduct. I actually work 50 hours a week on site min then 10 hours min from home which site manager knows but now doesnt admit the arrangement to HR.
They have even took records for last 12 months and matched days on my time sheet with no record of site attendance via the swipe system so they accusing me of not been on site on these days too. Sometimes I be attending meetings off site or sometimes you forget your access card and security issue you with temp. They refuse to check these records!! Grrrr
Its boils me the fact they waited till I went on holiday and even the site manager didn't even have the balls to raise his concerns face to face! Spineless
I won't walk away esp since I been successfull and don't want reputation for this bull ...!
I refused to turn up to meeting 24 hours after letter but now it's Friday
Any advice?
Main thing here I think is the swipe system. Is it legal? Even tho doesn't cover the whole site?! Also not a company policy or mentioned in contract!?

Can't you show them the written confirmation of your arrangement to work from home for 10 hours a week?0

They must know that the system doesnt cover all the site. If you was out at internal/externam meetings do you have proof of this? How was they arranged? Via email? Phone call?

Yes, the swipe system is legal - although there should be a way of accounting for the at home, travelling and 'didn't sign in' times.
Do you have written proof of your manager saying its ok to work from home? Even an email between you two saying "working from home today"?
Secondly you posted you need to be on site for 46hrs and yet you do 50hrs on site and 10hrs at home? So... (except for meetings) shouldn't your clock ins be over 46hrs anyway?
By the way, their initial report always will be one sided in their favour - especially if they don't have all of the info straight.
(Question: Have you tried speaking directly to your manager that authorised the home/work arrangement?)0
