Leaving job during probationary period

Hi

Wonder if anyone can help me with the 'legalities' of resigning from a job during a probationary period. Haven't definitely decided to go yet so don't want to bring it up with HR and rock the boat unnecessarily.

I'm a little over half way through a 6 month probationary period. My contract stipulates that I have to give 1 month's notice once I have finished probation, but doesn't say anything about my notice period during probation. The contract does state that the company can give me 1 week's notice during probation, so would that mean the same applies to me giving notice?

Also, would I accrue holiday during a probationary period? I work standard 9-5.30 Monday - Friday and get 23 days holiday per year. I haven't taken/won't be taking any holiday up until I leave (if I do), so would I be entitled to holiday pay on leaving?

  • If there is no mention of notice period during probation then the standard 1 week would apply, and yes you accrue holiday which is usually paid on leaving but they can ask you to take it during your notice period.

    The statutory legal minimum is 28 days pa, so presumably bank holidays are on top of that?

    Yes, subject to them being able to give the required amount of notice (twice the length of the holiday IIRC). Tricky if there is more than a couple of days holiday owing and only a one week notice period.

    2 days(mon/tues) notice for Wed off, 4 days(mon-thur) notice for Fri off

    if you start friday for a weeks notice then you have sat sun to play with

    They have got to be on the ball and act quickly. The OP doesn't have to offer that information.
