Experto Credit have pulled a fast one

Hi all I have been advised by a MSE to move this post here. I would have delated my OP but don't have a clue how to do that.

Hi all I hope someone can help. My father was in debit and owed a company £14300. The company had instructed Experto Credit to claim the money. Owing to the stress it was causing him (only has a couple of years to live due to long term illness) I decided to pay as much of it off as possible.

I spoke via telephone to an Experto Credit agent and offered a final settlement figure of £7800. He stated he would call the company concerned and ring me back. He rang me back and informed me the company would accept payment as final settlement.

I paid the agreed amount over one credit and one debit card and made sure that it was final settlement with no other fees attached.

I have now received a letter which states I owe them the final £6504.30 even though I have just paid the final settlement figure.

I have contacted the banks and they have paid the company.

I am now at a loss as to what to do as this sneaky company has tricked me into parting with £7800 in the that it was final settlement.

Could anyone advise me if I can do anything about this

    Yes there is. Send them 1.00 with a request for a true copy of the original credit agreement. Send that to the DCA. Then send a letter to the original creditor . From them it is the subject access request. This will put your account into dipute. The account should be put on hold while they provide you with relevant paperwork . Was the debt sold on DCA. Are there any charges that can be reclaimed. While the account is in dispute they should not chase you for the money.

    I would contact them first of all - I work for a finance company - not experto - and I know that when we do a short settlement, the money has to appear on the account before closing it down, and generally these figures are simply " agreed" and not calculated by the system in any way( as would happen if you paid the " normal" settlement). it basically relies on someone then going back in and closing the account down manually at a later date, so it is possible that it has simply been missed. Before you panic I would give them a call on Monday and explain, and see what they say. I have seen many cases with us where customers have received letters after paying a reduced settlement, and this is almost always whats happened - the agent simply hasn't kept a note to go back into the system, and its not intelligent enough to know it's anything other than a big payment

    Did they write to you confirming that what you paid was indeed a full and final settlement?

    I called today and as scotsgirl pointed out, the had not cleared payment but the matter was sorted the following day and the letter despatched by mistake.
