Problem returning chilled foods

Hi all,

This is my first post on this website and im not sure if ive put it in the correct place.

I have had cause in the last few months to return one or two chilled items with my receipt to the local tesco but when i have tried to do so i was told that i wasnt able to return them because of a law/rule (i cant remember the name they used) that states if its out of their chilled section for 25 minutes then i have no rights to return it.

Are they correct or do i have rights in this instance? If i do have any rights whats the name of these rights?

Im quite a savy person, meal plan and have minimum food waste.

    Its the same with Sainsburys. Obviously if the product has become mouldy before the UB date, then we can offer an exchange or the money. If its a branded item, the receipt is required as proof of purchase as we don't know that you bought in store or Mr T etc.

    The reason that we have a 30 min rule is that we can resell that product if you honestly changed your mind or purchased the wrong item in a 2 for £x deal and the offer wasn't flagged.

    This makes complete sense to me. If the item isn't being returned because it is faulty and would therefore be binned, then the shop can't just put it back on sale because it has been not chilled for a period of time. It might cause someone food poisoning. More than 30 minutes is potentially dangerous.

    They are only obliged by law to offer a refund if the item is faulty/not as described. If you've just changed your mind any refund is on a goodwill basis. Of course they won't offer a refund if they don't have to when they can't re-sell the product.

    Why are you returning the goods? Was something wrong with them or had you changed your mind?

    If you're at ASDA and they try to tell you you cannot bring back chilled food because of the 20 minute rule, point out that ASDA regularly puts chilled YS food outside the fridges on the edge. I had food poisoning after buying ASDA YS sausages. No other supermarket does that.

    How can you meet the supermarket's 20/25/30 minute rule, if the private ticketing company's terms & conditions for the car park don't permit you to return for 2 hours?
    The acquisition of wealth is no longer the driving force in my life. :)

    very much depends on WHY you want to return the items. Are they faulty or have you just changed your mind ?

    At ASDA you could easily spend 20 mins waiting in the customer services queue.

    Not sure why cs or till operators say you have 20 mins to return stock to stay within the 20 min rule chances are by the time the cutoemr has put the item in their trolley/basket done their shopping, queued and paid the 20 mins to return the item to the fridge has already passed and the item needs wasting. I've always set the policy if the chilled item is being returned under any change of mind policy the refund is to be refused as you don't know how long the item has been out of the fridge by the time its even reached the checkout.
