Thats really encouraging news, have you heard of any success in court then using a 'Four Party' argument?
We have written twice to Barclays Partner Finance and they say their decision is made but i'm wondering whether we should write to them one more time with this new information or go straight to the ombudsman.
No personal experience though I did study law and what Barclays have told you just feels wrong.....and the government site I looked at certainly seems to say that in these sort of cases the finance company is jointly liable! They actually quote cases on the site so you should be able to use those.
I would be tempted to write to Barclays one more time directing them to the case law and saying that failure to reimburse you will lead to a referral to the Ombudsman. You should note, however, that their duty is to either refund or to provide alternative training and this seems to be at their discretion; the training, though, must be of similar standing and must not cause unnecessary problems for the trainee - this is also on the site I posted
