Employer not paid wages..

Friday we were due my fellas wages, Nothing received!! We have direct debits for bills and rent to pay!! literally with 3 kids live from one payday to the next!
Anyway .. where does he stand, he was promised them in by the end of the day but still nothing!
This was the email they sent to everyone end of friday!!
Unfortunately despite the very best of efforts of all involved there is going to be a slight delay in the receipt of wages into bank accounts this month. We are trying our very best to ensure that all staff will be paid their wages on Monday 3rd of September, however, there is a possibility this delay could extend to Wednesday 5th September. With this in mind we would suggest that, if possible, you contact your bank to inform them and if possible request Direct Debits or Standing Orders are delayed.
This unfortunate circumstance is purely down the fact of three important changes which are taking place within the company; these are Payroll coming under the responsibility of the Accounts Department, Change of the Company Bank Account and the Transfer of Financing Facility to another provider all of which have taken place in the last few days.
We are doing everything we can to get the payroll and payments processed ASAP and apologise for any inconvenience this has caused. If you have any queries or would like to discuss this matter please contact myself in the accounts department.
Once again, please accept our most sincere apologies for this situation.

This amounts to breach of contract, but how seriously you wish to take it will depend on whether you believe that he really is going to be paid by Weds, and if you believe the reasons given for the delay in being paid.
Frankly this stinks to me of a company that is about to go under - have there been any other signs that the company is struggling? If so, I'd start applying for other jobs now, just in case (if we say that it takes at least a couple of weeks to find a new job, then you'll have a better idea of whether he really will be paid by then, and therefore know if he should take any new job offered or not).
If he isn't paid by Weds, then raise a formal grievance and take advice from ACAS.
If this is going to cause late payment charges / bank charges / similar then I would go and speak to the accounts dept tomorrow morning, as it simply isn't on that this has happened with so little notice, especially if it really is due to the reasons stated - I'd be claiming those late payment / bank charges to the company.0 -
Ok, he is going to go to work as normal tomorrow, Its awful as he is supposed to be on holiday so we can spend some time with the kids, we are also moving so its come at the most worst time ever (not that there is a good time!!) but just feel exhausted with it all!! thank you for your reply! Lets hope its in soon or I will be back for more help!!

I'd also sugguest that he respecftfully ask that any late payments fees be covered by work....
If he was due pay on Friday, and that email came end of day Friday he wasn't goven much time to move DD and standing orders payments...

They have said they would but then thats 'talk' Nothing in today, apparently all the big managers are down today for a meeting to discuss! He was only taken on in January (his last company was going under and he had to get out and get another job! Reason the last company went under was because they lost this big contract this NEW company gained!! So its not if they don't have the work!!)
Anyway! he is calling around today trying to enquire on new jobs, but will be calling the office to see whats going on in a while!

All three at the same time? Not many companies would do all three at the same time unless there is a very good reason - such as change of ownership/legal entity etc. Or even something far more sinister... but I'm trying not to scare you here as it could just be very bad planning on someone's part.
They are liable to repay all charges caused by this so be ready to get a bank statement showing all overdraft fees and returned payment fees etc.
Also unless they are going to resend the salary payments by CHAPS (which will be expensive) they should of be able to confirm that the BACS was submitted/sent on Monday for value into the bank on Wednesday - BACS normally takes three days to be received.0 -
I actually work for this company as i recieved the exact same email on friday. Nice to know i am entitled to claim any bank charges back. As ive been told today the top managers are coming tomorrow to inform us the reasons for the late payments etc. Ive also been told it could be monday next week before i am paid (this could be all, half or a percentage of my wage). Any help with steps i can take would be welcomed.0

Update on situation is that we still havent been paid and that the company has gone into administration and making redundancies. To find out if you are being kept on or not is you will recieve a cheque in the post today if your staying and nothing if your redundant but you will then have to go and see the administrators to see what money you can get and it could take a few weeks to get it. Names have been seen on some cheques and ive been told that im one of the people NOT getting one and will be redundant. So for me im owed Augusts pay plus a days overtime and upto this date in September and 7 days holiday. Does anybody know what else im entitled to.0

Rambo29, you need to contact the Administrator to claim wages owed. If they tell you they are unable to pay you, they have to provide forms for you to claim form the National Insurance Fund.

You also need to 'sign on' to start a claim any Benefits available as you would normally when unemployed.British Ex-pat in British Columbia!0
