RMA please help!

im dealing with rma from a barclay card . they have treated me awfull. i fell behind on my payemnts as was signed off work wen i was 5 month pregnant. i was self employed. after trying for housing benfit etc i was reciving 107 a wk my rent was 110 i had to sell up and move back to my parents. i rang and offerd them 5 a month sent a fincial stament which they sed they never recieved n wont take my payments over the phone they were even sugesting that i use my maternty grant to pay them!! i was fuming after i had my son again they wont take payments off me so i was using a giro sent another stament off to them then set up a standing order to them every month for 10 that was last feb.
they got in touch with me saying they r going to take me to court for the full amount wen i asked them did they recive all my payments they sed yes i sed were any of them late they sed no!! but sed barclay card had looked into my account and it was them that were taking it further! wen i rang them up they sed rma were dealing with my account! i have just managed to get on my feet i dont need this ive offered to go up to 15 a month but they want 20 and another stament. i have already a ccj which im 2 yrs into now and i dont want it to happen again what is the best thing to do any help will be grate full. im working part time now and living in rented accomdation with my son. if you need any more info just ask thanks:mad:

    I am so sorryto hear these people have treated you like this.
    The first thing you need to do is to write to RMA and ask that further contact is by letter only and a statement of payments to date along with a full balance.

    Send them a statement of means as well, I think this will help in your case so it won't be a waste of your time, if you can only afford £15, you send them £15 a month, I doubt whether they'd not take the payments from you in any case.

    IF they do take you to court and I do say IF because they may be using it as a scare tactic, then the court may decide that you can pay less or indeed they are happy with your arrangement with RMA is satisfactory and leave it at that.

    You could also write to Barclaycard and ask them to re-take over the account and deal with them instead, if they say no, at least write to them to tell them how badly RMA are behaving!

    Another thing you could try which my husband did, is you could use a free counselling service to manage your debt(s), like CCCS (https://www.cccs.org.uk) or PayPlan (https://www.payplan.com).

    Thanks you. i need to speak to them but i dont have a house phone to get in touch it means going the phone box with a 15month old ! to go round in a circle. im just so disguted in how they speak to me this site is so helpfull! im thinking of applying to calim back my chargers n that in its self will clear my debt with them going to have a look at that pay plan ive seen quite a few people mention them and tehy've sed all good stuff

    I'd put my hind teeth on this that its just a scare tactic to put more pressure on you.

    And lets face it, to a degree, its worked as you have now gone up to £15 a month in reply (btw - I hope that does not sound as though I am Criticizing, Im not, just trying to illustrate how they work).

    There is just no mileage in them taking you to court, and they know this - as said above, more likely you could end up paying less a month!

    Send in an updated statement of affairs to them and carry on making the £15 payments - and then dont worry about it!

    This is all just a game that we debtors have to get used to playing Im afraid - but it can be fun sometimes!

    Keep making your £15 payments and DEMAND that all communication between RMA and yourself is conducted in writing. Send copies of ALL letters to the Customer Services Manager at Barclaycard, with a covering letter stating that you are paying all you can afford and that you will report any harrassment by the 'bullies' at RMA to the Trading Standards Office as you have requested that they contact you only in writing therefore any further telephone contact is in contravention of the guidelines, laid down by the Office of Fair trading, and to which RMA should adhere.
    In the UNLIKELY event that RMA take you to court, you should say, in your defence, that you have been making regular payments and can not afford more. The judge will consider your circumstances and is most unlikely to ask you to pay any more than you can afford - he may, as previously suggested, actually reduce your minimum payments. Once a court order, for payments, s issued then BOTH parties, including RMA, must respect it.
    They will NOT be allowed to harrass you for more.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • I agree with the above. I am with RMA they kept hasstling me. I had an agreed payment every month and they had said it was not for a set date. As long as they got a payment for that month. I usually pay by internet banking at the beginning of the month and this can take up to a week to clear. They would leave messages telling me to ring them immediatley then send a letter stating they had tried to contact me and i ignored it. I sent another letter telling them not to contact me by phone as ii would be only dealing with them in writing. That i was making my monthly payments as requested each month. I have not heard anything from them again, so far!

    Don`t worry just send your payment of £5.00 each month, don`t answer calls if you do hang up or don`t confirm Data Protection they cannot go on with call unless you confirm this they would be breaking the law. RMA cannot take you to court if you are paying what would they say to the judge, your paying but - but what they would get laughed out of court, write to them every 3-6months confirming payment and circumstances still the same nothing they can do, there just bulling tatics they are a business in it for money - take no notice - debts not life threatening - just get on with life?
