Hi My ex and I divorced in 1995, we had two kids now almost 20 and 17, he was and still is self employed, he still lives in our 'maritial home' (things got so bad I left - another long story) His then new girlfirend and her 5 year old moved in (same dayI went!) They married 3 years ago and now she has left him (her dau (17) is still there)and they are divorcing. He has had four liability orders against him from the CSA (he's never paid regular maintenance). The first one in 2003 the bailiffs managed to make him pay in full £10k. The other three are still outstanding, the bailiffs tried again but have failed. I have told the CSA about his divorce and the fact I want my liability orders to take precedence over his 2nd wifes claim etc. all they say is it takes time to get the accounts perfect before they can ask for charges to be put on the property. Can I take him to court myself for the money? How can I get the CSA to move more quickly (I already phone them and 'push' them frequently)?

I guess you had a solicitor when you got divorced? He ought to have sorted your claim for a fair settlement of the joint property at the time and an agreement for maintenance until the kids reach 18 or in full time employment. This would be enforceable by court order and thus no need to involve the CSA.

The property settlement wasn't easy either, my ex kept stalling and it took about three years in total, as I was on income support at the time I was only eligible to keep £3000 of any monies I got and my sols fees were £9k (although I was legally aided) My sol advised me to take the £3k and go. They also told me to leave the maintenance side to the CSA as they were already involved.0

Once they have a Liability Order, there is no reason why they can't apply for Charging Orders on the house - you need to push them for this. The figures have already been calculated in respect of the Liability Orders, so there is not a lot of extra work involved - just the application stuff for the Charging Orders themselves. It should take about 6 weeks or so. Ring up Enforcement and ask them why they can't apply for a Charging Order straight away considering the Liability Orders already exist? In my case, as soon as the Liability Order was granted, they applied for a Charging order, it was only a matter of a couple of weeks inbetween - I think they are stalling.0

You should be able to find your CSAC centre. Don't speak with your case officer, but speak to an Complaints Resolution officer. Take their name and direct phone number.0
