outstanding public record

Hi,

Over a year and a half ago I sold my house to clear debt.

My credit report still shows an outstanding public record for the ccj we had with a rbs personal loan!

Any ideas how to get rid of this?

  • It should be marked as satisfied, but I believe it will remain on your file for 6 years from when made.
  • I am with credit expert and they are saying its outstanding when I know for sure its not as solicitors etc were involved in getting it cleared when I sold my house.

    Do you think a phone to credit expert should do it?

    Surely I won't need to chase up the sheriff court?
  • Ask your bank in the first instance.
    Your solicitor probably would only have paid off secured creditors unless you gave them specific instruction to pay off this particular loan as well.
    Anything left over would have been sent to you with a completion statement. Do you have this document and if so what does it say?
  • You can get a certificate of satisfaction from the court that dealt with the CCJ, the fee is £15, or at least it was a couple of years ago. That will then serve as proof to the CRA or anyone else.
  • This loan was tied to my property and we weren't able to sell it unless the loan was paid (rbs took us to court for this) so I assumed that the solicitor dealt with all this!!!

    I did receive a statement from my solicitor showing all debt paid and what was left and this is on it but I'm confused as to why my credit report isn't accurate?
    Should rbs confirm it?
    It was a year and a half ago and it shows as outstanding. Its the only negative thing still on my report and I've assumed everything was fine and we should just sit tight and be good pay bills etc and we'll get sorted . . . Now this!

    Your solicitor should have ensured any inhibition(s) were notified as being cleared when the property was sold. The debt will have been cleared, but he should have followed through. It will be the bank who instruct the Certificate of Satisfaction - ask them why they haven't, as this is their responsibility.
  • If its on the completion statement ask your solicitor to deal with it.
  • I'll contact rbs first and see what they say !
