Agency Charges.

This is my third job for an agency.
Really like this one, but agency want to move me to another assignment next week.

Even though I was only at this job for one week the company really liked me and want to "poach" me.
However I believe Agency may want a temp to perm fee.

If I quit the Agency and then the firm take me on could the Agency still sue for this fee.

At the end of the day, don't see how the agency would know I'd been taken on by them!

    It depends on the terms that the employer agreed with the agency, but if you are taken on by them the agency will find out - it's a small world!

    It is worth noting that if the agency had a suspicion that their client had taken you on, they could ask a court to order the client to attend court. They would then be asked if you were working there, and the small claims action would continue on those grounds.

    If the employer wants to take you on then no reason not to accept, surely they are the ones to know if they are likely to upset the agency.

    I was only at the company 4 days.

    They would like me to take up permanent employment, but if fees are involved they would have to think twice about it.

    The charge would depend on the contract they had agreed to with the agency, it may be a percentage or a fixed amount. The people with the answers to your questions are your employer/ the client. ;)
  • I was actually assigned to a company, who then sub-contracted me to another company!

    Despite Agency promising me long term contacts each job has only been for a few weeks before they move me on.
    Suspect they are avoiding the new legislation which gives you rights after 12 weeks!

    Absolutely correct. It's not anyone else's business. The client wants to keep you then they abide by their contract with the agency. Which 99% surely involves a fee being paid.
  • Depending on the size and age of the employer I doubt the fees would be much of a consideration. When you decide to use agency rather than doing your own recruitment you know whats involved and that you exchange the unknown costs of doing your own recruitement for a known set of fees.

    Fees are individually negotiated but can be up to 30% of the fully loaded annual salary (ie any benefits like company car or pensions are factored in). Temp to Perm tend to be a bit lower because the agency has already made profit from the temp work.

    If the Agency are your employer, then moving you to a new assignment does not avoid the Agency Worker's Regulations and your accrual of the necessary 12 weeks. Therefore, this will not be the reason.

    Uncertainty is the nature of the beast with agency work - whilst they can hope a contract will be long term, the client company can end the assignment at any time. It is part of the appeal for client companies, and usually they don't have to give a reason.

    But yes, there will be a temp-to-perm fee and the agency will find out where you have gone sooner or later. If the client company use the agency alot, they will not want to damage that relationship by taking you on but dodging the fee they are contractually obliged to pay.

    They will either charge a % fee or ask for you to be kept as an agency worker for a certain amount of weeks. I've seen it before they charge a slightly higher 'upgrade' from what they are paying you per hour than usual and then after so many weeks (say 12) you can transfer to being an employee of the company with no extra fees to be paid.

    Its the employers consideration to deal with and not yours however and they should be the ones sorting it out with the agency.

    My daughter was placed in a 4 week temp job in May 2011. After 2 weeks they said they wanted to offer her a perm position but could only do it after the 4 weeks was up other wise they would have to pay a 'finders fee' or something of that nature. She finished the 4 week contract had a week off and was handed a perm contract. I can't see you being charged any kind of fee....but hey i maybe wrong.
