desperate and depressed

Hi all, this may be a long one, so here goes.
I first applied to the csa in september 2008, but they only made a payment calculation in july of this year (backdated to july of 2011!!!). Due to all their !!!!-ups they have admitted serious maladministration and paid me £200 compensation (tiny amount considering the grief they have given me), and i'm waiting for a special payment too - which i can only get once my ex starts paying (which of course he never will). :(
My major problem is this - he is currently self-employed, but has told me the company has closed so he is now unemployed, but he won't claim benefits cos he doesn't want the csa to find him and send him to prison (he moved into his own flat once his mum kicked him out, but he hasn't told the csa his new address and won't tell me it either (obviously)). I asked the csa what will happen now, and was told he can tell them his family are paying his bills etc and they will just believe him!!!!! Surely that can't be right?? If u have to prove ur income via payslips etc, surely he'd have to prove how he's supporting himself, especially as he has spent the last 4 years being non-compliant, telling them lies, and ignoring them???
Please help me, as i just don't know what way to turn now. I have been fighting them for so long, and cried too many times over all this. Our 5 year old daughter doesn't deserve this (he's too busy getting drunk in the pub and sleeping with anything with a pulse to bother with her), i didn't make her on my own, so he should be forced to support her financially as i always have done.

    Sorry you are not recieving the CS contributions you were hoping for, for all his bad points, you made a baby with him.
    Turn your energy to more quality things in life , naturally keep the CSA case open as things may change, but as you have gone so long without contribution, then it is not really the end of the world :o

    Apply for a variation on the grounds of lifestyle not consistent...

    They will then need proof of where the money is coming from for rent etc, and if it is not provided, then they will assess as if he has a job and will prder payment, which he probably won't pay, but it will rack up arrears and get it closer to enforcement...!
  • Sorry you are having to go through this. This is a difficult situation - one i have faced too. They need to be able to get hold of your ex partner so they can ask the same questions you are. If he is not working or claiming any benefits then how is he supporting himself and why isn't he claiming benefits he is entitled to? Good luck and keep chipping away and calling the CSA surely he can't avoid them forever (that thought keeps me going). Sounds like he has a rubbish life anyway and at least you have your daughter :)

    Apply for a variation on the grounds that his lifestyle is inconsistent with his income and then if it fails (most of them do!) APPEAL. That way you get to go to a tribunal and they will ask him the questions and ask him to provide evidence. You must appeal!!!
