Payday express DMP help- GOT WORSE

Im starting on a self managed DMP and so far have managed to negotiate with most creditors. Payday express are refusing to help without meeting their criteria with evidence. Merely 'financial difficulties' doesn't seem to be acceptable. Only unemployment or serious illness (which other than going on maternity leave I've just been stupid and over calculated my incomings and financial commitments.
Obviously I know they don't have to agree but bottom line is I can't afford to pay it all back in one go. But I am more than happy to pay it back. So what do I do next? They won't accept that I'm in financial difficulty because I am still employed even though not working. What can I do now?

Payday express have now contacted me via email. it says:
"please be advised that we have held any action on your account until (14 calender days) to allow your debt management company to send us a letter of authority via post. we recommend you request your debt management company contact us urgently.
if we have not recieved any notification from your debt management company of their involvement within 14 days the hold will be removed and your account will resume collection activity"
my problem is that i decided to go down the route of self-managed DMP and therefore dont have a debt management company, but i think it seems like they wont agree unless i go through a company, which i doubt i can do in 14 days. what can i do? i dont even know what a letter of authority is???

You could quote the following extract from the OFT guidelines, It's not that specific but may help.
• exercise forbearance and consideration – in particular towards debtors experiencing difficulty - we would expect businesses to work with debtors with a view to providing them with reasonable time and opportunity to repay debts and, where appropriate, to signpost them to sources of free independent debt advice
• act proportionately when seeking to recover debts, taking into account debtors' circumstances - actions taken in respect of arrears or default should give proper consideration to available options and the likely effect of such actions on the debtor 180 -
Yes I've sent them my soa three times and they've ignored it. They've also ignored the whole DMP. Just keep telling me I need to prove unemployment, serious illness or pay in full.

still not getting anywhere with payday express. i write them an email and get a generic answer about ringing them instead. so i email them back and say i wish to be contacted in writing in accordance with OFT's guidelines, and they say yes fine send us your SOA, which i do. then i get the email about ringing them again and we go round in circles. i've had a letter from them today which was a notice of default sums and telling me they will add the cost of sending letters to my account. and again telling me to ring them. i've rung them twice and they really applied the pressure so i dont feel comfortable ringing again, i need to have proof in writing. i posted them my SOA and a letter of repayment offer but they seem to be ignoring it and are more interested in getting me to ring them than to look for a solution (i can understand why). they are also ringing me a good 8-10 times a day and texting me to tell me i havent made contact (which i have) and thay my account will be passed to a DCA if i dont contact them?? not really sure what to do about them now??SELF MANAGED DMP

I was in a similar situation with Payday Express - in the end, I basically begged them to accept my repayment offer (Think it was approx GBP 40 per month on a GBP 240 balance). They said the same to me as they have done to you - basically they would not accept my offer unless I was unemployed, critically ill etc.
In the end, they had to accept that I couldn't pay the amount in one go, so I paid it off 40 at a time. If they refused that, then I had no idea what io could do. The incredible thing being - that after they finally accepted my offer, after about an hour and a half on the phone to one of their staff and two managers, the manager told me that I could still take out a loan from them again in future if I continued to simply roll over the interest! Ridiculous.
Anway, good luck with them. They will have to realise eventually that it is in their best interests to agree a repayment plan with you.Getting married to a wonderful lady on August 10, 2012.

Your going about this the wrong way with all due respect.
You tell them what you will pay, send an SOA showing your Income and Expenditure and that is the end of it. Keep records of all communication.
You have to understand that Payday Express do not care one little bit about you, so do the same with them and treat them with contempt.
If they refuse to accept your offer, send it anyway, and complain to them. When they refuse to answer your complaint, then you got to the FOS.
They refused point blank to accept my DMP through CCCS, so they paid them anyway and I got sold off to McHall who just accepted the DMP.
Do not let the bully you. YOU TELL THEM WHAT YOU WILL PAY, not the other way round.

thank you both for your advice. just wondering, how do i send them payments as i dont have any account information for them- they wont give me it. i think paying some off while this is ongoing would be in my interest but i've got no idea how to without details or handing over my card info, which i really dont want to do as i dont trust these people, espeically without them agreeing to a planSELF MANAGED DMP

I had a similar thing with QuickQuid, wouldnt accept anything so in the end I let them send it to debt collections agency (motormile) who have been amazing and accepted £5 a month and have now increased at my request never any pressure from them!
Please do not worry about it - have you got a nice spreadsheet or something to help manage it? I have been on self managed dmp since Jan - good luck and feel free to ask anything

A very good question. In your position, I would send them a cheque - or failing that, you need to WRITE to them offering bank payment and asking for account details for a standing order. State that you will not permit them to have a direct debit Keep a copy of your letter, keep the money you are planning to pay them to one side. As long as you have evidence that you have offered to pay - repeatedly - and they have either refused or ignored you, if they are stupid enough to take it to court, then they are not going to get much sympathy - plus if court papers arrive, you can offer immediately to pay the money you have put aside.princess18 wrote: »updated in the OP
