not sure what to do

Till last week i had 2 part time jobs, 1 in the morning 7am till 9am walking home an hour each way. Then afternoon job with the council 3pm till 5.30pm walking 45minutes to collect kids and get them home. Im a married mum of 3. 1 of whom doesnt live with me, will explain that after though. Between me and DH we were getting £250.00 his wage after tax weekly, and £122.77 after tax with both my jobs. £240.10 working, child and childcare element tax credit.

I currently have an ongoig court case which didnt entitle me to legal aid and still doesnt as its based on my employment status when i applied. Im trying to get my oldest DD back hoe, who is now 15 and wants to live back with her parents and sisters. (i was 12 when i had her, started AF at 9 and BD at 11, oops.. very wrong i know). Anyway.....

now:

Im dismissed over a tiny non abusive disagreement, (bear in mind the retail stores manager is the directors daughter) for writing a complaint to the company who my contract works for (cleaner), obviously my employer doesnt want to lose the contract with the retail store. Only doing 12.5hours a week now and bringing in £62.77 a week.

heres the problems,

im not entitled to income support based on my DH income with mine, as im registered disabled.

Im not entitled to my usual working disability tax credit nor the childcare element. however, i still need childcare in the afternoon and DD3 who will be starting nursery for free in the mornings, needs to be looked after for 1 hour in the afternoon so i can get to work on time.

I also have £3110 legal fees to pay out.

Im not entitled to contribution based ESA as i dont pay NI due to work pension with afternoon job. I dont pay tax as dont earn enough. Not entitled to incapacioty based as my disability isnt a physical nature..

In addition to this, if i start a new 2nd job, i have to go on sick for 3-6months in december due to an upcoming hysterectomy at only age 27. not gonna look good.

Ive got 2 debts outstanding aside from this, thankfully on a payment pplan before i got dismissed and still managable and not creditors.

what now.......?

  • Outstanding debts and legal fees are irrelevant for calculating benefits. The only real solution is to try and find another 3.5hrs from somewhere to put you over the threshold where you'll qualify for the disability component of WTC.

    The question appears to be about what/if any benefits the OP can claim and how they can find a job again, given an upcoming operation. Not too sure on the legal claim though, whether it relates to the cleaning job in the intro or a different job. Also not too sure with regards to the disability.
    OP - is the operation related to your diasbility? Is your disability mental? Only reason is not to be nosey but more I think people might be able to help a little more if they had a brief idea of the disability. I also believe that mental disabilities and 'hidden' disabiities are still considered disabilities.

    It does sound to me as if you may have been dismissed for whistleblowing. Has your ex-employer provided you with a copy of their whistleblowing policy?

    as for whistleblowing. ell no. ive had 2 jobs for 5years and neiter are against eachother and different shifts. I had grief off a part time sales assistant, isimply told her not to speak to me like that, its notacceptable on work premses. she gets on with the new store manager.

    as i already stated ive an upcoming hysterectomy, no relation to disability at all.
