bailiff refusing a pay by instalment offer! HELP!!!

I received a hand posted letter while i was in 4 days ago. The person made no attempt to knock on the door at all and it is my belief that they actually tried to silently slip it through without having to talk to me. I have a dog that sits by the door all day and barks at anyone that comes near it!

The letter was from a bailiff from phoenix commercial collections stating that I it was a notice before removal. Across the letter in black marker he had scrawled '24 HOURS NOTICE BEFORE REMOVAL'

I immediately phoned the number on the notice ans spoke to the man. I said that it was impossible for me to pay the balance of £643.08 within 24 hours as i have £2 in my account. I told him that i am a single mum of 2 children who is living on income support. I offered him a payment of £100 upfront as i have a necklace that i can pawn to get that amount. I then offered a further £25 weekly which equates to a big part of the money i receive each week.

He told me that he would NOT be prepared to accept any form of payment plan and he could not delay the removal at all.

I informed him that the day of the intended removal was my nan's funeral and so he postponed for 24 hours and told me that's all he was prepared to do.

I phoned him back 10 mins later and said to him that i may be able to pay the full balance at the end of the month as my dad comes home from holiday and he might lend me the money. He then said he would hold off until 11am on the 31st of this month but if the full balance wasn't paid over the phone (which is subject to a payment fee) he was going to enter the property and take goods.

Unfortunately i can not borrow any money and therefore can not clear the balance. i can still offer the payment of £100 and then £25 each week after that. [/SIZE]

WHAT CAN I DO TO TOP THIS PROCESS?
CAN HE REFUSE A GENUINE OFFER?
CAN I CONTACT THE COURT TO SUGGEST A PAYMENT PLAN?

PLEASE HELP!!!!!!!!! :(

    There is a difference between debt collector and bailiff.

    I do not believe anyone can enter your house without a Court Order/Warrant.

    If they do without such they are practically breaking and entering which is illegal and you should call the police.

    If however they have a court order/warrant to do such then you must comply. You would be well aware if they have such a notice though.

    You should contact CCCS, Payplan or CAB for more advice.

  • Ok, so has the bailiff levied on your goods? Generally happens when you meet with a bailiff and allow him entry to your home or if there has been a prior visit and a vehicle parked outside your house.

  • Well about 2 years ago I did let a bailiff in and he made a list of about 5 things which were the dining table and a mirror and other thing of practically no value, that bailiff did accept a payment plan and over a few months I cleared the debt. This bailiff is from the same company but not the same person. I have not let this bailiff in, in fact I have never seen him. I don't own a car so he can't have made a levy for a car outside.
