Employer not paying agreed salary

Hi,

I have recently, 3 months ago, gained new employment and as with all employers I conditionally accepted their offer on the phone pending contract in writing. At this point they confirmed the salary would be X while I completed a probation period before rising to the advertised Y after probation.

I received my contract in the post and under the renumeration details only salary X was stated. I rang my new employer to say that the part about rise to Y was not included and they said to bring my contract in on my start date and they would amend it there and then.

3 months down the line and I am still waiting for this contract and have recently been told that I will now no longer receive the advertised Y as there isnt enough money in the 'pot' to pay me. This comes after a member of staff was made reedundant 2 weeks ago.

The amount of money to increase to advertised Y is 10% of the salary I currently receive while completing probation.

I have chased it now on numerous occassions and had a meeting about it today as ive kicked up such a fuss only to be told X is the salary and would I sign a contract to that effect to which I said no.

Where do I stand on this? Any advice is appreciated.

I have the original job advert stating advertised Y etc.

    a paper contract trumps word of mouth, if they are now saying you will stay on x amount then there is nothing you can do about it, you either need to leave or accept that the wage will not increase, if you make too much of a fuss then you too will likely be asked to leave.

  • So even though Ive asked for this to be amended I cant do squat? They could have sent me a contract for half of Y and id have to live with that? Surely that cant be right?

    Yes it is, if one thing is said to your face and a different thing on paper the law will always take the written contract as the one to go by, it is wrong they have lied to you but not much you can do about that.

    I can appreiciate what youre saying but short of tell them to amend it before I even show up, assuming this happens again, there is nothing that can be done? This seems highly immoral and completely unlawful if you ask me.

    If something was advertised in a shop at £100 but then you got to the till and it was £120 you could ring trading standards, but in this situation its just, ah well, leave my job or be forced to work for less than the job I applied for?

    I agree but you have the Government to thank for the labour laws, which leave us with next to no rights, with all the trouble in the economy, what do the Tories do but allow employers to sack anyone for any reason within 2 years!

    As said it's wrong but nothing you can do apart from asking them to change their mind and hope to not !!!! them off.

    I do know however that im now the 5th employee in this position within a year (through employee choicce) so you'd be thinking they'd try and keep me.

  • Na they havent, they have all left through either not being able to handle the stress or not being able to actually do the job. This I have found out from various employees in the office.

    Do you want to keep the job? If it's a choice between keeping the job at X salary, or leaving, which will you do?

    Because with less than 2 years' in this job, you have very few rights, and it would be very easy for them to find reasons for you to leave, notwithstanding the time they've spent working on your development plan ...

    If you continue to work, you will be deemed to have accepted the contract. The fact you have not signed it is irrelevant.

    Unless you're in a role where it isn't easy to be replaced, your game of brinksmanship can only end up badly in a country with over 2 million people on the dole.
